For three days, the most serious alarm for justice did not come from any court decision, but from a political act carried out in open violation of the law: the “inspection” of the courts by Fatmir Xhafaj, in his capacity as the chairman of the Committee for Civic Initiatives. Visits that are not foreseen by any legal provision and that directly violate the principle of separation of powers have become a fait accompli, while the political reaction has been minimal, delayed and selective.
So far, the only formal reaction from the opposition has been a Facebook status by the head of the DP parliamentary group, Gazment Bardhi. But a more careful reading of the composition and functioning of the Commission itself is enough to understand that this silence is neither a coincidence nor a lack of information.
The current composition of the Committee for Civic Initiatives, Cooperation and Institutional Oversight is public and clear:
– Fatmir Xhafaj, chairman (SP)
– Ivi Kaso, deputy chairman (PD)
– Permanent members from the opposition: Belind Këlliçi (PD), Elda Hoti (PD), Gjin Gjoni (PD)
The key fact is that the plan of "monitoring" visits to the justice system was approved by the Commission. So, the representatives of the Democratic Party were aware of Fatmir Xhafaj's plan. And they did not speak out. Just as they are silent today.
While the visits were carried out "de facto" in the Tirana Court (including the Court of Appeal), as well as in the courts of Elbasan, Korça, Shkodra and Fier, there has still been no public reaction from this commission. At least from opposition MPs. No political alarm, even though it was a flagrant interference of the legislative power in the territory of the judicial power.
The question that naturally arises is simple: why did the opposition wait and not raise the alarm? Why didn't it denounce this act before it happened? Why did the reaction come only after the issue became public and became a public debate?
The delayed reaction, through a status on social networks, does not change the fact: the representatives of the DP in the Commission were aware and did not raise their voices. They may have voted against, but they were aware of the fact. They simply remained silent and continue to remain silent, even though the visits have been carried out and the precedent has been set.
Whether by himself or by order from above, we will understand this in the coming days. But one thing is clear: the problem in this case is not only Fatmir Xhafaj and his attempt to exert political pressure on justice through illegal "monitoring". The problem is also an opposition that, although directly involved in the process, chooses to speak (except to wash its mouth) only after others have spoken first.
What is happening today with the control of the courts is not simply a procedural violation. It is a dangerous institutional precedent, where courts accept visits without legal basis, where the ILD and KLGJ remain silent, and where the opposition chooses to react only when the political cost of silence becomes apparent.
The attempt to bring justice under political control is not new. What makes it even more worrying today is the fact that this attempt is happening with the knowledge and silence of those who claim to be its defenders.
As for the fluid Xhafaj-Berisha agreement to put justice under control, the Hallexhi have shown that they forget their insults and anger in front of the common enemy.
