SPAK completes the investigations and submits for trial the criminal case against the former mayor of Memaliaj, Gjolek Guci, and three other defendants.
Guci is charged with "Violation of equality of participants in tenders or public auctions", committed in collaboration. Former Deputy Mayor Edmonda Harizi; Feta Hoxha, former Director of Public Services at the Memaliaj Municipality, as well as businessman Bersant Ylli, administrator of the entity "Bersant Ylli" are also accused of the same criminal offense.
According to SPAK, the investigations were launched based on a report from the High State Audit Office. The object of the investigation was the procurement procedure "Construction of the Regional Water Supply for the villages of Vasjar, Iliras, Qesarat, Anë-Vjosë, Toç, Lulëzim, Zhulaj, Krahës and the city of Memaliaj", of 2021, with the contracting authority being the Memaliaj Municipality.
The investigations have revealed that the Mayor of Memaliaj Municipality, citizen Gjolek Guci, on September 21, 2020, signed the donation contract with no. 658/1 Prot., with the economic operator "Artreum Generation" sh.pk, represented by the administrator A.Sh. While the project for the implementation of the construction of the regional water supply was approved by the Mayor of Memaliaj Municipality.
The fund for the facility, worth over 493 million lekë (493,183,572), was divided into items for construction, assembly, management and commissioning of the works. The approved value was the same as the cost value of the project donated by the company “Artreum Generation”, a subcontractor of one of the winning companies of the tender.
After analyzing the procurement procedure documentation, it was found that the members of the Bid Evaluation Commission, citizens Edmonda Harizi, Feta Hoxha, Bersant Ylli and the head of the contracting authority (Memaliaj Municipality), citizen Gjolek Guci, in collaboration with each other, have created unfair advantages and privileges for third-party operators, by qualifying and declaring the winner the joint venture of economic operators "KEG" sh.pk & "ED Konstruksion" sh.pk, which had deficiencies in the submitted documentation, especially in the criteria for technical capacity.
Also, subcontracting was accepted with the economic operator "Artreum Generation" sh.pk, which was in a conflict of interest, as it had donated the project and drafted the technical specifications and did not meet the legal criteria for a subcontractor.
