Today's decision by the Constitutional Court means that the clash between the government and the judiciary is not over, but has been postponed for a full institutional confrontation. On January 21, 2026, in a public session, representatives of SPAK, GJKKO, the Prime Minister's Office, the Presidency and the Parliament, through their lawyers, will present the arguments for and against.
The Constitutional Court will interpret Article 103 of the Constitution and will answer the fundamental question: should a member of the government cabinet be suspended from office while under investigation by SPAK. This is the essence of the conflict between the executive branch and the justice system. The Prime Minister goes even further, claiming that the GJKKO has violated the powers of the President and the Assembly.
Today's decision does not affect SPAK's investigations. The investigations against Balluku continue and she remains officially a defendant for suspicions over the Llogara tunnel tender and favoritism in procurement procedures.
