Doksan Dushku, convicted of murdering his daughter in 2014, is moving the Supreme Court, hoping to alleviate the sentence that justice has given him.

11 years after the shocking event, the 81-year-old is seeking the revocation of the conviction and the final sentence of 14 years in prison, because a paragraph of the article related to the concurrence of sentences has been repealed. Specifically, he requests “the revocation of decision no. 69, dated 02.06.2015 of the Court of First Instance for Serious Crimes in Tirana, a decision which was left in force and became final with decision no. 74, dated 07.07.2015 of the Court of Appeal for Serious Crimes in Tirana, due to the repeal of the second paragraph of article 55 of the Criminal Code, added by law no. 144/2013, repealed by decision no. 9, dated 26.02.2016 of the Constitutional Court of the Republic of Albania. The determination of sentences for several criminal offenses (article 55 of the Criminal Code) in force to give a single sentence, with 21 years of imprisonment consisting of the most severe sentence added. In application of article 406 of the Criminal Code, the final sentence of 14 years imprisonment".

Dushku was sentenced in 2015 to 24 years in prison, which was reduced to 16 years due to a summary trial.

If the request is accepted, the elderly man is on the verge of being released from prison.

The murder of the girl

On 28.05.2014, at noon, the Operations Room of the Dibër District Police Directorate received a report that Fatmira Dushku had died in the village of Sllatinë, Sllovë Municipality of the Dibër district, and that the cause of her death was suspicious. The police went to the apartment of Doksan Dushku, the deceased's father, and there they found her family and relatives, and the deceased put in a coffin in one of the rooms of the house. The officers contacted and questioned the deceased's family, and at the same time conducted an inspection and control of the interior and exterior of the apartment, and from the data, it resulted that Fatmira Dushku had been killed a few hours earlier, around midnight between May 27 and 28, 2014, by her father Doksan Dushku. Doksan Dushku himself admitted this.

The investigation revealed that Doksan Dushku's wife had died and he was living with his daughter and two sons. Meanwhile, he had "forgiven" the other son to his brother Ahmeti, because he had no children from his marriage. The two brothers lived in two apartments a few meters away from each other.

Fatmira Dushku Dushku, had been unmarried and had not been in a working relationship. Finally, the defendant Doksan, had noticed that his daughter was pregnant. He had asked her how she had become pregnant, and she had hesitated to tell him the name of the person with whom she had become pregnant. However, from conversations with her daughter about this, the defendant had managed to understand that the person who had most likely made her pregnant was one of the sons of a distant cousin of his, AH. The latter had a house in the same village as her. He had two sons, one of whom was A... Although not so convinced of this, and because his daughter was unmarried, the defendant had decided to inquire with the doctors at the Peshkopia hospital, to enable his daughter to abort the baby, because for her it would be a great shame if she had really become pregnant with a boy with whom she had a distant tribal connection. For this reason, on May 24, the defendant Doksan met an employee of the QM hospital at the Peshkopia Hospital, whom he asked to help him have an abortion for his daughter. The doctor advised him not to do this, but to give birth to the child, and for his daughter to live with the person she wanted. But after the defendant told him about the suspicions he had about the person who could have made her pregnant, he said that the doctor would be interested in doing something, and that he could bring his daughter to the hospital the next day. The next day, the defendant Doksan did not take his daughter to the hospital in Peshkopia, while at lunch on May 27, 2014, the doctor met AH (the father of one of the boys whom the defendant suspected of having made his daughter pregnant) and told him about the conversation he had had with the defendant. AH, not believing that such a thing had happened, called a boy who was abroad, and he was assured by him that he had nothing to do with this. Then he called the other boy A., who was a student and was in the city of Peshkopia, and told him to come home urgently that day. The boy left immediately and arrived home that evening. On the evening of 27.05.2014, the defendant Doksan had called his brother A. and his son R. to his house to talk about how they would decide about Fatmira's pregnancy. After they had stayed for a while, they had left from there. Ramazan had gone to A's house, where he had also found A (the student). There, the student had denied that this was true. They all decided together and went to the defendant's house (the time must have been around 22/22:30 in the evening). Here they found the defendant, Fatmira, and the little boy H., who was asleep. Here, after the conversation, Fatmira had said "I love A (the student). Not believing her, A (the cousin) told the defendant Doksan that the next morning, the two of them should send the boy and girl to the Peshkopia hospital, to do the tests,and if this turned out to be true, then they would continue living together, but according to him, his son would no longer have a place in his house, and on the contrary, they would no longer have any business with each other (meaning that they would no longer be considered relatives). That night, the meeting between them did not last long, and they left the defendant's apartment. The defendant remained at home, with his daughter and two sons. At that time of night, the defendant and his daughter were awake, and the defendant was standing in the yard of the house, while the daughter was doing housework, when around midnight the defendant took an automatic weapon from behind the house, and at a moment when the daughter was in the yard of the house doing housework, he shot her with a burst of fire in the body, causing her instant death. The shots were also heard by the defendant's brother and his son, who immediately came there (the houses are very close) and found the defendant Doksan with a gun in his hand. They are shocked by what they see, and yet they take the gun from his hands and place it somewhere behind the house. There, the defendant decides to present the murder he committed as a natural death of his daughter, and for this, the coffin had to be ordered and picked up in Peshkopi. In the early hours of May 28, Ramazan went to Peshkopi with a driver and picked up the coffin and brought it to the apartment. Meanwhile, on the morning of this date, the defendant Doksan broke the news that his daughter Fatmira had died, and that the funeral would take place at 2:00 PM on this date.
