The Durrës Prosecution Office is seeking life imprisonment for citizen HM for the murder of his father and 3-30 year prison sentences for other family members who collaborated in the crime.
The Prosecution at the Court of First Instance of General Jurisdiction, Durrës, requests the guilty plea of the defendant HM for committing the criminal offense of 'Murder due to family relations' committed in collaboration as provided for by Article 79/ce 25 of the Criminal Code and his sentence to life imprisonment.
Within the framework of the investigations into criminal proceedings no. 386, year 2024, it was proven that the defendants HM and H. Meta., brother and sister, in collaboration with each other decided and planned the murder of their father, citizen PM.
The defendants, after having calmly thought and crafted their plan to kill their father, prepared by taking measures for the place where they would carry out the murder, for the means with which they would carry it out by securing a firearm, a plan carried out on 10.02.2024. On 10.02.2024, a Saturday, the defendants were in their apartment in Shënvlash, Durrës, while the defendant AM was at work.
The victim PM left work in the early hours of this morning and left for his apartment. Around noon on 10.02.2024, the victim was in the kitchen of the apartment, at which time his son, the defendant HM, in the presence of the defendant HM, after taking a firearm, shot his father four times. One of the bullets did not touch the victim's body, while three of them, one in the head and two in the body, resulted fatal, causing instant death.
The two defendants then carried out actions not only to eliminate the traces of the murder by plugging the hole in the wall, moving the sofa on which the victim was lying, they continued by wrapping the body, burying the victim's body in the cattle shed which was located a few meters away from the apartment and then continued by removing the vehicle from the apartment, disappearing the victim's personal belongings and disappearing the crime weapon. After committing the crime, they ensured that all traces that were hidden by the defendant HM This citizen filed a police report, presenting the disappearance of her father as a departure from the apartment of his own free will. During the trial, the defendant, the only one of the defendants who gave consent to be questioned, stated that her brother HM killed her father in her presence.
In the court session on 16.09.2025, the prosecutor requested:
1. The guilty plea of the defendant HM, for committing the criminal offense of "Murder due to family relations", committed in collaboration, as provided for by Article 79/ce 25 of the Criminal Code, and his sentence based on this provision to life imprisonment.
2. The guilty plea of the defendant HM, for committing the criminal offense of "Unauthorized possession and production of weapons, explosive weapons and ammunition", provided for by Article 278/4 of the Criminal Code and his sentence based on this provision to three years of imprisonment.
3. The guilty plea of the defendant HM for committing the criminal offense of "Hiding and Disposing of a Corpse", committed in collaboration, provided for by Article 303 and 25 of the Criminal Code and his sentence based on this provision to 5 years of imprisonment.
4. In application of Article 55 of the Penal Code, the combination of the above sentences into a single sentence, that of life imprisonment.
5. The guilty plea of the defendant HM, for committing the criminal offense of "Murder due to family relations", committed in collaboration, as provided for in Article 79/ce 25 of the Criminal Code, and his sentence based on this provision to 25 years of imprisonment.
6. The guilty plea of the defendant HM for committing the criminal offense of "Hiding and Disposing of a Corpse", committed in collaboration, as provided for in Article 303 and 25 of the Criminal Code, and his sentence based on this provision to 5 years of imprisonment.
7. In application of Article 55 of the Penal Code, the combination of the above sentences into a single sentence, that of thirty years of imprisonment.
8. The guilty plea of the defendant AM for committing the criminal offense of "Hiding and Disposing of a Corpse", committed in collaboration, provided for by Article 303 and 25 of the Criminal Code and his sentence based on this provision to 5 years of imprisonment.
9. The guilty plea of the defendant Bl. M. for committing the criminal offense of “Actions that impede the discovery of the truth”, provided for by Article 301 of the Criminal Code and her sentence based on this provision to three years of imprisonment.
