The Prosecutor's Office at the First Instance Court of General Jurisdiction in Tirana issued three security measures for three citizens, IA, 'Arrest in prison', E.Gj, 'Obligation to appear' and ML, 'Obligation to appear', suspected of involvement in the creation of fraudulent schemes related to value added tax (VAT), 'Hiding income', as well as 'Forgery of seals, stamps or forms', provided for by articles 144/a, 180 and 190 of the Criminal Code.
In the framework of the investigations on criminal proceedings no. 2578 of 2025, in cooperation with the Tax Investigation Directorate, at the General Directorate of Taxes and the Economic Crime Section at the Tirana Police Directorate, it resulted that the commercial entities "Allmeta 02", "TT" and "Valbona Alb", have carried out suspected fictitious sales in favor of the entity "5D Konstruksion", with a total value of 370,299,847 lek, generating a VAT and Profit Tax calculated in the amount of 108,004,122 lek.
The subject '5D Konstruksion' has been investigated by the Special Prosecution Office, sending the citizens, GC, EM, TM and B.Ç. to trial at the conclusion of the investigations. This subject is suspected of having fictitiously increased the costs for public works tendered by the Municipality of Tirana, by administering and declaring fictitious invoices issued by the persons under investigation, IAEGj. and ML with a value of around 370,299,847 lek.
These actions were carried out through false declarations and the use of fictitious invoices, with the aim of creating a fraudulent fiscal scheme, which aimed to unfairly benefit from VAT crediting and reduce the taxable base for Profit Tax, thereby damaging the financial interests of the state.
The investigation revealed that the full value of 370,299,847 lek, created through suspected fictitious sales, was included by the entity “5D Konstruksion” sh.pk in the work situations declared in public tenders, with the aim of artificially increasing the volume and costs of the work performed. This value was reflected as a justified expense in the documentation for the implementation of public contracts, enabling the beneficiary entity to collect from public funds the full value of this fictitious transaction, to the detriment of the state budget. As a result, the actions carried out have not only created unfair tax advantages, in VAT and TF, but have also resulted in the unjustified appropriation of public funds, through the false presentation of expenses in the financial reports of the tenders.
In this context, the coordinated actions of these entities constitute the constituent elements of the criminal offense of "Creating fraudulent schemes related to Value Added Tax", in collaboration, within the meaning of Article 144/a and Article 25 of the Criminal Code.
Investigations continue to identify other persons involved, as well as to fully document the fraudulent scheme and its financial consequences.
