
The DP Parliamentary Group has sent to the Constitutional Court its disapproval of the establishment of the Assembly's Investigative Committee to control the legality and administration of IPARD II program funds in agriculture.
The DP emphasizes that the overthrow of a constitutional right of the opposition by a political vote of the majority makes the role of its deputies in the Assembly not simply negligible, but above all a facade of a false normality that kills the rules and minimum standards of democratic parliamentarism every day.
This, the DP group emphasizes, has seriously questioned the need for the opposition's presence in the Assembly, but on the other hand, it harms the public interest because MPs cannot exercise their responsibilities and functions.
If the opposition cannot discuss in the Assembly issues that are of interest to citizens, if it cannot exercise control over the government, if it cannot push forward the adoption of laws/amendments in the interest of citizens, if it does not respect its rights recognized by the Constitution of Albania, then its role in the Assembly is merely formal, failing to fulfill its responsibilities in a democratic society and thus damaging the system of checks and balances between powers, as a guarantee for the democratic functioning of the Albanian state.
"We request the Acceptance of the request for the addition of the subject matter of request no. 11 (J), dated 12.11.2025, which is being reviewed by the Constitutional Court, as follows:
"- In point 1 of the request, it is added: "1. Resolving the dispute of competence between no less than a quarter of the deputies and the Assembly of the Republic of Albania, by determining the obligation of the Assembly to establish the Parliamentary Investigative Committee: "(iii) For the control of the legality and administration of the funds of the IPARD II program (Pre-Accession Instrument for Rural Development)."
After point 3, point 4 is added: “4.Declaration of decision no. 12/2026 of the Assembly of Albania “On the non-approval of the draft decision “On the establishment of the Parliamentary Investigative Committee for the control of the legality and administration of funds of the IPARD II program (Pre-Accession Instrument for Rural Development)”, as incompatible with the Constitution of the Republic of Albania.
Resolving the dispute over competence between no less than a quarter of the deputies and the Assembly of the Republic of Albania, by determining the obligation of the Assembly to establish the Parliamentary Investigative Committee: "On the control of the legality and administration of funds of the IPARD II program (Pre-Accession Instrument for Rural Development)," states the DP's request.
