SPAK has issued an arrest warrant for Ergys Agas, suspected of being part of a structured criminal group in the file related to AKSHI. But yesterday evening, in the "Top Story" studio, under the direction of Grida Duma, a clear line of public defense was built for him, by lawyer Maks Haxhia and criminology professor Ervin Karamuço.
Haxhia questioned the very existence of the “structured criminal group”, arguing that the overthrow of this element would take the case out of the competence of SPAK and would transfer it to the Prosecutor's Office of General Jurisdiction. According to him, Agasi “has no company in the field of AKSHI” and “has not participated in tenders”, while the evidence mentioned – videos with seconds and meetings with ministers and MPs – do not constitute, in themselves, a criminal offense.
"I have 45 years in jurisprudence and I have never heard that meeting a person is a criminal offense," said Haxhia, adding that SPAK is either incompetent in this matter, or has stepped outside its procedural function and is playing a dominant role in politics.
On the other hand, Ervin Karamuço, who appears on screen as a professor, stressed the need for full expertise before issuing arrest warrants, raising questions about the concrete evidence and mentioning another claim made in the media about the existence of a structured group within the tender system itself, which would have operated “under the nose” of the relevant managers. He emphasized that “no report has been finalized,” describing this as a problem of effective investigation.
Essentially, the public defense articulated in the studio aimed to shift the debate: from the essence of the accusation of a structured criminal group and influence in tenders, to the procedure, competence, and interpretation of evidence.
Meanwhile, the official silence on the full details of the file leaves room for public interpretation, but the essential question remains: are these just meetings and fragments of disconnected footage, or part of a wider mosaic of evidence that will be tested in court? None of Agas's 3 lawyers last night had anything to say about this. Meanwhile, his official lawyer did not give an answer as to why his client did not return to appear at SPAK after Haxhia himself declared a few weeks ago that: Agas had gone to sign a contract and would return to Albania.
