The ministry led by Belinda Balluku, currently under indictment by SPAK, has failed in several respects to fulfill its obligations to the European Union.
The Ministerial Council of the Energy Community, composed of energy ministers from all EU countries, has adopted a decision finding that Albania has failed to implement its obligations arising from the Energy Community Treaty, violating a number of key European Union directives and regulations in the field of the electricity market.
The decision was taken following a formal institutional investigation and follow-up procedure, initiated by the Energy Community Secretariat on 29 May 2024, as well as following the opinion of the Advisory Committee dated 24 November 2024.
According to Article 1 of the decision, Albania has not adopted and implemented in national legislation a number of essential EU acts for the functioning of the energy market.
Albania has also failed to timely notify the Secretariat of the measures taken, in direct violation of previous Energy Community decisions of 2021 and 2022, as well as Articles 6 and 89 of the founding Treaty.
The Ministerial Council urges Albania to immediately take all necessary measures to correct the violations and ensure full compliance with Energy Community legislation.
The decision also sets a deadline: July 1, 2026.
If by this date Albania has not corrected the violations, the Energy Community Secretariat is invited to initiate further proceedings under Article 92 of the Treaty, which provides for punitive measures, including restrictions on the country's rights in the Energy Community structures.
This decision constitutes a strong political and institutional signal for the Albanian authorities, at a time when the country aims to deepen European integration and harmonize with EU standards in the strategic energy sector.
