
Tirana Prosecutor's Office indicts 2 gynecologists for 'Neglect in medical treatment', failure to act in time led to the loss of the newborn's life
The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, completed the investigations and charged two gynecologists of the 'Koço Gliozheni' Maternity Hospital, citizens EV and AH, with the criminal offense of 'Neglect in medical treatment', provided for by article 96/2 of the Criminal Code.
From the entirety of the investigative actions carried out on criminal proceedings no. 6713, registered following the report made by citizen AZ after losing her baby during the birth process, and from the expert reports, it clearly emerged that the baby's death was the result of severe injuries during birth, caused by the use of forceps, a tool commonly used in difficult births, when natural birth does not progress or when it is too late for surgical intervention.
According to the forensic medical examination report, the injuries that led to the baby's traumatic hemorrhagic shock are not the result of an unpredictable complication, but a direct result of the lack of timely intervention, which would have avoided the use of forceps if the birth had been performed by cesarean section, as previously planned.
The inaction of the defendants, the doctor who took care of the pregnancy process, and the doctor on duty, in violation of their professional obligations, were the decisive factor that led to the development of a dangerous birth process, which ended with the tragic loss of life of a newborn child.
