
The Regulatory Commission, as expected, has failed to rise to the occasion by approving the distorted lists sent by Commissioner Celibashi.
Although the issue of violation of the Code with the lists presented by the Commissioner was raised in the Commission, the Chairperson of the Commission has not accepted that the lists be approved according to the criteria of the Code.
Regulatory Member Çakaj asked representatives of the CEC administration "how can one resign from something that has not been won, when the result is finally announced by the Regulatory Commission."
The administration representatives "clarified" that only one standard was followed.
But following one standard according to them means looking at the procedure for appealing the commissioner's acts in a robotic manner.
"In the case of the SP in Fier, Article 71 of the Constitution was applied, because there were no subsequent appeals after the resignation of candidate Maldrita Bardho, who left the mandate to her colleague Zegjine Çaushi. Whereas in other cases there were also appeals and situations different from the one above."
The decision of the College clarifies that the cited Article 71 is the competence of the Assembly and not of the Commissioner.
The play on words, however, revealed the support that Commissioner Celibashi has from the SP for the violation of the Electoral Code and the Constitution that is cited as being without any harm.
The Chairperson of the Commission, Ilirjana Nano, seems so convinced of the invalidity of the Commission she leads that she stated that the meeting is not being held to make a new decision, because it was made by the three levels after appeals, but to announce the final result:
"For all 12 decisions, we have had appeals or recount processes and in the end we have final decisions from the KAS and the College, as well as 12 CEC decisions for the distribution of mandates. The decision-making process has passed all administrative and decision-making levels and we are in a position to announce the result and not decide something new. The appeal procedures have ended and we are within the deadline to make the decision, this is a discussion in principle."
