The Constitutional Court unanimously dismisses 44 DP deputies, Endri Shabani

The Constitutional Court has unanimously rejected the request of 44 Democratic Party deputies, who opposed the election of Endri Shabani to the position of Ombudsman.

In the plenary session held on September 29, based on documents, the deputies requested the verification of eligibility and incompatibility in exercising the function of the Ombudsman, as well as the repeal of the Assembly's decision of December 11, 2025 on his election.

The court assessed that some of the claims raised by the deputies, including those related to the signatures of the 28 supporting deputies, the rule "one deputy supports only one candidate" and the political agreement between the parliamentary majority and minority, do not raise constitutional issues.

Regarding the claim that Shabani did not meet the constitutional criterion of having knowledge and recognized activities in the field of human rights and law, the Constitutional Court concluded that there was no violation of fundamental procedural guarantees or arbitrariness in the procedure followed by the Assembly.

The court also considered the claim related to the political activity exercised by Shabani to be unfounded. According to it, political activity constitutes in principle a cause of incompatibility with the exercise of the function, but in the specific case, referring to the moment of the Ombudsman's oath in the Assembly, the claim did not hold.

The claim of the lack of the necessary support of the deputies at the time of the vote was also dismissed. The court argued that the condition of support from 28 deputies was met at the stage of verification of the candidacies by the Laws Committee and that the withdrawal of support after this stage could not have consequences in the further parliamentary procedure.

In conclusion, the Constitutional Court unanimously decided to reject the request of 44 deputies. The full and reasoned decision will be published within the legally stipulated deadlines.

DECISION NOTICE

On 29.09.2026, the Constitutional Court (Court) considered in a plenary session on the basis of documents the case with the applicant a group of 44 deputies of the Assembly of the Republic of Albania (Assembly), in the capacity of a constitutional subject of no less than one fifth of the deputies (applicant) with the object of verifying the eligibility and incompatibility in the exercise of the functions of the Ombudsman, including the verification of the procedure for his election to office, finding it incompatible with the Constitution, as well as the repeal of decision no. 111/2025, dated 11.12.2025 of the Assembly “On the election of the Ombudsman”.

Gjykata, bazuar në objektin e kërkesës, si dhe natyrën e thelbin e pretendimeve të parashtruara nga kërkuesi, vuri fillimisht në diskutim çështjen e juridiksionit të saj për shqyrtimin e kësaj çështjeje.

Gjykata, bazuar në përmbajtjen e shkronjës “e” të pikës 1 të nenit 131 të Kushtetutës, vlerësoi, fillimisht, se Avokati i Popullit përfshihet në kategorinë e funksionarëve të organeve të parashikuara në Kushtetutë, sipas kësaj dispozite, për rrjedhojë edhe çështjet që lidhen me zgjedhshmërinë e papajtueshmërinë në ushtrimin e funksionit të Avokatit të Popullit dhe verifikimin e zgjedhjes së tij përfshihen në juridiksionin kushtetues.

Po në këndvështrim të vlerësimit të juridiksionit të saj, Gjykata, pasi mori në shqyrtim pretendimet e ngritura nga kërkuesi, vlerësoi se ato për: i) nënshkrimet e 28 deputetëve mbështetës në një listë të vetme; ii) mënyrën e zbatimit të rregullit të brendshëm “një deputet mbështet vetëm një kandidat”; iii) interpretimin e nenit 72 të Rregullores të Kuvendit për tërheqjen nga rendi i ditës të projektvendimit për zgjedhjen e Avokatit të Popullit; iv) ekzistencën e marrëveshjes politike mes shumicës dhe pakicës parlamentare sipas së cilës Avokati i Popullit duhet të vijë si kandidat i pakicës parlamentare, nuk ngrenë ndonjë çështje të nivelit kushtetues.

Për sa i përket pretendimeve të tjera të kërkuesit për zgjedhshmërinë e Avokatit të Popullit në kuptim të plotësimit të kritereve kushtetuese dhe për papajtueshmërinë në ushtrimin e funksionit, si dhe për verifikimin e zgjedhjes së tij, Gjykata vlerësoi se bëjnë pjesë në juridiksionin kushtetues ndaj u ndal në vlerësimin e tyre në themel.

Në lidhje me pretendimin për mosplotësimin e kushtit të zgjedhshmërisë të parashikuar në pikën 2 të nenit 61 të Kushtetutës, sipas të cilit Avokati i Popullit duhet të ketë “njohuri dhe veprimtari të njohura në fushën e të drejtave të njeriut dhe të ligjit”, si dhe hetimin nga Komisioni i Ligjeve në këtë drejtim, Gjykata arriti në përfundimin se Kuvendi në zgjedhjet brenda procedurave parlamentare që përfshijnë vlerësime profesionale të kandidatëve për funksione kushtetuese gëzon diskrecion me kusht që të respektojë garancitë themelore procedurale dhe që procesi mos të ketë arbitraritet. Bazuar në këtë standard, në rastin konkret, në procedurën e ndjekur nga Kuvendi, Gjykata nuk konstatoi cenim të garancive themelore procedurale apo arbitraritet.

Për sa i përket pretendimit për veprimtarinë politike të ushtruar nga kandidati për Avokat të Popullit, Gjykata konstatoi se, në parim, veprimtaria politike, parashikohet nga Kushtetuta si shkak papajtueshmërie, që ndikon në ushtrimin e funksionit. Në rastin konkret, referuar momentit të betimit të Avokatit të Popullit në Kuvend, Gjykata vlerësoi se pretendimi i kërkuesit është i pabazuar.

The court also found the applicant's other claim for verification of the election of the Ombudsman to be unfounded, due to the lack of support from the deputies at the time of his vote in the plenary session.

The Court notes, first of all, that the requirement for the support (proposition) of candidates by 28 deputies is not a rule established by constitutional norms, but is provided for in the Organic Law on the Ombudsman and in the Rules of Procedure of the Assembly. The purpose of the procedural rule for the support of candidates by deputies is to ensure the effectiveness of the parliamentary procedure, in view of its outcome, and is not related to the exercise of the legislative function by the Assembly. In the case under review, this condition was met at the time of the verification by the Laws Committee of the candidacies and their passage for voting in the plenary session. In this way, the process had brought concrete consequences, therefore the withdrawal of support after passing this stage can no longer bring consequences in the subsequent parliamentary procedure.

In the end, the Court unanimously decided to dismiss the request.

The final decision will be announced with reasons within the legal deadlines provided for by Law No. 8577, dated 10.02.2000 “On the Organization and Functioning of the Constitutional Court of the Republic of Albania”, as amended by the Regulation on Judicial Procedures of the Constitutional Court.
