The Special Court has decided to refer the case against Democratic Party MP Arjan Ndoja to SPAK, ordering the initiation of criminal investigations.
Judge Erjon Çela, after reviewing the case regarding the termination of the investigation in proceeding no. 1804 of 2023, which was sent for subject matter jurisdiction by the Tirana Court of First Instance, found that the request for termination of the investigation was invalid. He decided that SPAK should register criminal proceedings and initiate investigations against the MP.
The court assessed that the status of the investigated subject had changed during the process, and therefore the competence for the investigation belongs to the Special Anti-Corruption Prosecutor's Office.
The acts were returned to SPAK with a request for the investigation of two criminal offenses: " money laundering" and "concealment or failure to declare assets ."
