Inter's Spanish goalkeeper Josep Martinez is under investigation after the tragic accident that occurred on Tuesday morning near the city of Como, where Paolo Saibene, 81, lost his life. According to initial reports, Martinez was traveling in his BYD car, a hybrid SUV, towards Inter's training center in Appiano Gentile, when the fatal collision occurred.
Preliminary investigations suggest that the victim may have shown signs of destabilization just a few meters before the incident and then suddenly entered the lane of the janitor's vehicle. Local police forces have obtained all the necessary data to reconstruct the dynamics of the accident and determine legal responsibilities.
At the scene, Martinez's vehicle was seized and the road was blocked for hours, while investigators are analyzing any elements that may help clarify the circumstances of the incident.
In legal terms, he will be charged with manslaughter in a traffic accident, a provision that provides for different penalties depending on the level of culpability of the driver. If it is proven that Martinez violated traffic rules, he could face a sentence of 2 to 7 years in prison, as well as a license suspension. If his responsibility is considered minor and not related to the road, the sentence could be reduced to 6 months to 5 years, including a fine.
However, sources close to the investigation indicate that the circumstances of the incident suggest a pure accident rather than a violation by the janitor. If it is confirmed that the pedestrian's behavior was unpredictable and extraordinary, then Martinez will not be considered criminally liable. In this case, the case can be filed, while the compensation will be borne by the insurance company. According to Italian law, when the victim's behavior is unpredictable, the driver of the vehicle is not liable for the consequences, provided that it is proven that he respected all traffic rules and acted with due care.
