When the Special Prosecution Office (SPAK) requests the lifting of immunity for a member of parliament, the procedure in the Assembly follows steps clearly defined by the Rules of Procedure of the Parliament.
As soon as the Speaker of the Assembly receives the official letter from SPAK, the request and accompanying documentation are immediately forwarded for review to the **Council for Rules of Procedure, Mandates and Immunity**, while the deputy for whom the request was submitted is also notified.
The Council consists of **9 MPs**, where **5 are from the majority and 4 from the opposition**. Its members are:
Bledar Çuçi, Bledi Çomo, Elda Hoti, Niko Peleshi and Taulant Balla from the majority, as well as Gazment Bardhi, Gent Strazimiri, Oerd Bylykbashi and Saimir Korreshi from the opposition.
The Member of Parliament for whom authorization is requested shall be officially notified of the request and the documents accompanying it, as well as of the date on which the Council will begin its consideration. He shall have the right to submit written or oral explanations, to be represented by legal counsel, to ask questions and to seek clarifications, in order to exercise his right of defense.
At the end of the review, **within two weeks**, the Council drafts a report that is presented to the plenary session, recommending **approval or rejection of the request** for the granting of authorization for a security measure, such as prison arrest, house arrest, deprivation of liberty in any form, or personal or home search. This report is distributed to all deputies.
The consideration of the request shall be placed as the **first item on the agenda** at the next plenary session. At the beginning of the session, the floor shall be given to the deputy against whom the request was submitted, to provide explanations or to answer questions from deputies. The Council's report shall not be subject to discussion.
The final decision is taken by the Assembly by **open vote**, on granting or refusing the authorization requested by the judicial bodies. If the Assembly does not make a decision within **3 months** of the submission of the request, it is automatically considered rejected.
