After Daniel Shimë's dismissal from the position of deputy director of AKSHI, it seems that the "duty" to prepare the documents so that Ermal Beqiri's companies or companies indirectly controlled by him would win the tenders, is taken over by Hava Delibashi. Initially, the latter held the position of Legal Director and then took over Daniel Shimë's position as deputy director.
This emerges from an examination of the phone of Emirton Suli, one of the AKSHI officials, who had communications with Delibashi.
"The partial review of this citizen's communications has resulted in conversations of interest to the investigation, between this citizen and Hava Delibashi, who during the period of the reviewed communications held the position of Legal Director at AKSHI. The prosecution's request and the decision of the first instance court reflect three photographs from telephone communications, photographed from the screen, between Emirton Suli and Hava Delibashi. From the above communications it results that Hava Delibashi instructs Emirton Suli regarding his duties, in the capacity of procurement manager, these orders reasonably suspected to have been received and dictated or forwarded by her from the head of AKSHI, Ms. Mirlinda Karçanaj," the court's decision states.
In one of the conversations between them - the Court of Special Appeals - emphasizes that there is reasonable doubt that these orders are related to the list of economic operators declared winners, in the conversation dated 28.02.2024, 07:37:04, and following. "From the content of these communications, data are identified that create reasonable suspicion and based on evidence about the fictitiousness of the competition in the procurement procedure with the object 'Maintenance of the ATP WEB Gis system for the Property Handling Agency', for which Mr. Emirton Suli states that the second EO in the competition is the company 'Fastech' sh.pk, but that it has not submitted any documentation. From the verifications carried out, it results that the above procurement procedure was won by the company Communication Progress sh.pk. It is also recalled that this commercial entity is also related to Ermal Beqiri, since its partner with 50% and at the same time the administrator is G. Likaj, the cohabitant of Ermal Beqiri's sister."
It is further stated that "in the communication dated 12.03.2024, the communication between Ms. Hava Delibashi and Mr. Emirton Suli is interestingly evidenced, specifically regarding several economic operators to whom an invitation to bid is sent, requesting the replacement of the entity 'Intech +' sh.pk with the entity Soft & Solution sh.pk, which reasonably implies the fact that the heads of the contracting authority control the entire procurement procedure, favoring certain economic operators, specifically companies controlled by citizen Ermal Beqiri or related to him, from the moment of drafting the qualification criteria, the market study until the moment of declaring them the winner. There, Hava Delibashi states, among other things, that instead of an economic operator listed on the list (Intech+), Soft & Solution should be placed and move forward, writing the abbreviation 'pls' of the English word 'please'".
SPAK says it has targeted a criminal group operating within the AKSHI and has placed Ergys Agas and Ermal Beqiri on the wanted list. Mirlinda Karçanaj, the former director of the AKSHI, was placed under house arrest, while other suspects, including police officers, have been given lighter sentences.
