The Head of the Special Structure Against Corruption and Organized Crime (SPAK), Altin Dumani, in an interview on RTSH, spoke about the Justice Reform process and the necessity of maintaining the independence of the prosecution system from any political influence.
Dumani considered the separation of justice from political influence as the greatest achievement of the Justice Reform, emphasizing that this is the best outcome this reform can have to guarantee a fair and effective system.
According to him, the independence of special prosecutors — both from the prosecutor's office leaders (internal independence) and from external factors (external independence) — is the most important element that has occurred in the prosecutor's office institution since the launch of the reform.
"I believe that this independence of the prosecution institution should be preserved. Currently, this independence is guaranteed by the Constitution of Albania and other laws. It should be preserved, as it contributes to criminal prosecution, as well as concrete results in the fight against organized crime and corruption. This independence is also accompanied by accountability," said Dumani.
Regarding the question of whether the head of SPAK must report to the Assembly, Dumani explained that the current law is not very clear on this issue, recalling that the head of the Special Prosecution Office is not elected by the Assembly, but by the High Prosecutorial Council (KLP).
However, he emphasized that MPs have the right to be informed about the work of the institution and to express their concerns regarding its activities.
"Despite the long sessions and questions that sometimes should not be asked, I believe that MPs have the right to be informed about the work of the institution, as well as to address the concerns they have regarding the continuity of the institution," stated the head of SPAK.
Dumani said that he respects the Albanian Parliament and during reports, he speaks to the deputies, and not to actual or potential defendants.
