
An institutional clash has been registered between the Mayor of Tirana, Erion Veliaj, and the High Prosecutorial Council, regarding the procedures followed for the status of prosecutor Ols Dado.
In an official request addressed to the members of the KLP, Veliaj claims that his request for the determination of the absolute invalidity of the decree appointing prosecutor Ols Dado was not reviewed by the institution as a collegial body, but only by the vice president of the Council, Erind Gërmenji.
According to the document, during the review at the Administrative Court of First Instance in Tirana, it was found that there was no collegial decision-making by the KLP on this issue. In the same context, Veliaj emphasizes that the letter no. 413/3 prot., dated 11.03.2025, signed by Gërmenji, where it is claimed that “the KLP has reviewed the request”, does not reflect, according to him, the procedural reality.
The request argues that the issue was handled at an individual level by the vice president of the institution, and not by the KLP as a collegial decision-making body, as provided for in the relevant legislation.
Also, referring to Article 66 of the Law "On the Status of Judges and Prosecutors", it is emphasized that the competence to make decisions on the status of magistrates belongs only to the High Prosecutorial Council. In this context, Veliaj claims that the document signed by Gërmenji constitutes an invalid act, due to the lack of a collegial decision.
The request also raises doubts about the representation of the KLP in the judicial process by the institution's legal representative, alleging that she appeared without a mandate approved by the collegial body.
In conclusion of the request, the mayor of Tirana asks the members of the KLP to clarify whether they were aware that Deputy Mayor Erind Gërmenji had personally handled and decided on the issue of terminating the status of magistrate Ols Dado.
