
The Special Court orders SPAK to launch investigations regarding the demolition of buildings in the 5 May area. The Tirana Prosecution Office had previously investigated this case and had decided to dismiss it. One of the citizens, the injured party, appealed the decision of the Tirana court that approved the request to dismiss the case to the Court of Appeal.
The Court of Appeal decided to refer the case to the jurisdiction of the Special Court. The latter ordered SPAK to launch an investigation into the case. Erion Veliaj and Arbjan Mazniku have been charged with the destruction of the 5 May area, while the government's decision on the demolitions has also been challenged. SPAK will register the case for abuse of office, but during the investigation, other data or facts may emerge about other criminal offenses.

1. On 08.09.2025, a request was registered with the Special Court of First Instance for Corruption and Organized Crime with file no. 140, submitted for jurisdiction by the Court of Appeal of General Jurisdiction, with the applicant being the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Tirana, with the subject: "Dismissal of the criminal case with no. 1782 of 2022, registered for the criminal offense of "Abuse of office", provided for by article 248 of the Criminal Code, because the fact is not provided for by law as a criminal offense".
2. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of Judge Rudina Palloj, based on Articles 112, 128, 128/a point 1 letter “b”, 329 and 329/be et seq. of the Code of Criminal Procedure, with decision no. 140, dated 30.09.2025, decided:
1. Determination of the absolute invalidity of the request of the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Tirana, dated 14.04.2023, with the subject: "Dismissal of the criminal case no. 1782 of 2022, registered for the criminal offense of "Abuse of office", provided for by Article 248 of the Criminal Code, because the fact is not provided for by law as a criminal offense".
2. The transfer of acts that are with this court, forwarded by the Court of Appeal of General Jurisdiction, Tirana, to the Special Prosecution Office Against Corruption and Organized Crime.
3. The parties have the right to appeal against this decision within 15 (fifteen) days from the day after the communication of the reasoned decision to the Special Court of Appeal for Corruption and Organized Crime. Tirana, dated 02.10.2025
