The Democratic Party has taken legal steps against the government-approved package for protests, requesting the Constitutional Court to repeal three acts that, according to the opposition, violate the fundamental rights and freedoms of citizens.
The head of the DP parliamentary group, Gazment Bardhi, announced this Friday that a request has been filed with the Constitutional Court to repeal two normative acts, no. 5/2026 and no. 6/2026, as well as the Decision of the Council of Ministers no. 815/2026, dated October 28. The Democrats also request the suspension of their implementation until a final decision is made.
According to Bardhi, the changes approved by the executive give the State Police expanded powers to restrict gatherings, impose fines, and take measures against protest organizers.
One of the concerns raised by the opposition is the possibility of the Police restricting gatherings in certain areas for periods of up to 72 hours. Bardhi argues that such a power could violate the constitutional right of citizens to assemble and protest.
The leader of the Democratic parliamentary group also opposed provisions that provide for financial liability for rally organizers in cases where other participants cause damage. According to him, liability should be individual and organizers cannot be held responsible for actions they did not commit or instigate.
Another point of contention is the creation of a special registry for persons involved in criminal proceedings or investigations related to the protests. Bardhi raised concerns that this mechanism could violate the protection of personal data and the freedom of movement of citizens.
In addition to the battle in the Constitutional Court, the opposition has requested the summoning of the Director General of the State Police, Skënder Hitaj, to a hearing at the Human Rights Commission.
According to Bardhi, the head of the Police must provide explanations for the detentions, fines and use of force against protesters in recent weeks. He accused the police structures of actions that, according to him, have violated the right of citizens to protest peacefully.
In conclusion, Bardhi called on the Constitutional Court to urgently review the issue, while also requesting the attention of international partners to the measures taken by the government.
The Constitutional Court is now expected to review the Democrats' request to suspend the acts, before deciding on their constitutionality.
