Anti-SPAK politicians and analysts have repeatedly raised the alarm that this prosecutor's office has the right to wiretap judges. According to them, this is destructive because it undermines the independence of the judiciary and gives SPAK the opportunity to take judges hostage.
Altin Dumani answered quite clearly that the law allows SPAK to wiretap only within the framework of a criminal investigation and only if it has a court permit for this. So the prosecutor cannot do as he pleases to use wiretapping as a means of blackmail, but must have permission to do so, which requires prior evidence.
According to anti-SPAK voices, it is incumbent on judges to be impeachable, because otherwise they become susceptible to blackmail by the prosecution. According to them, a judge may be corruptible by those being investigated, but not blackmailable by the law.
The question arises, what should be done when a judge commits corruption? Of course, he should be investigated.
Who will investigate? Of course, the prosecution. But how can the prosecution investigate without collecting evidence and without wiretapping the suspect?
Of course, the prosecution can also abuse it, and for this reason, the law has established a check, which is the court. To wiretap a judge, just like anyone else, the prosecution needs to get permission from the court, and this is the most normal thing in the world.
What should be the proposal of the judges' lawyers? Make the judge uninvestigable and untouchable by the law, so that anyone can easily corrupt him whenever they want?
These accusations against SPAK can only be made by those who do not want a justice system that has the power to punish politics. Unable to prevent SPAK from investigating, despite strong pressure, they demand a court to overthrow SPAK and protect the abusers. Such accusations flood the media every day from those who want to destroy the only positive thing that has happened to this country in these years. That is why this country cannot get out of the quagmire of these 35 years. Because there are many people who are fighting to destroy every possibility of getting out of it.
