The preliminary hearing for the review of Erion Veliaj's lawsuit against Special Prosecutor Ols Dado, the prosecutor who investigated and filed 13 criminal charges against him, continues at the Administrative Court.
Veliaj claims that Dado was appointed prosecutor in violation of the law and demands that the presidential decree be repealed.
Here is the position of the Presidency representative:
Bërdëlmima: Mr. Bamir Topi exercised his constitutional rights.
We have a proposal from the Attorney General, an accompanying letter, and then the Presidency issues a decree.
We are not clear whether this is a complete practice. Are there any acts that the general prosecutor's office may have that we do not have?
We don't know how this act came about.
We leave this matter to your assessment.
The President does not deal with the process of evaluating the criteria.
From the Presidency archive, it turns out that we only have the proposal of the procurator general and an accompanying letter.
Veliaj: Are you telling me that there is nothing in this appointment but a letter?
Burdëlmi: We don't have a reasoned relationship in the archive.
Veliaj: If Babatas' Donkey said to appoint a prosecutor, would you issue a decree?
(Judge Hazbi Balliu intervenes: Not these terms).
Veliaj: I have folklore, okay. Aqif Kapertoni.
Would you decree Babatas' Donkey, without any accompanying relationship?
Bürdëlmi: Are you asking about 2026 or 2008?
Not today. I don't know how it was done back then.
