The Criminal Court of Kosovo has returned the criminal file against the former mayor of Kavaja, Elvis Roshi, accused of abuse of office, to SPAK for further investigation.
The decision was made by Judge Rudina Palloj, who, after reviewing the parties' claims in the hearing, asked SPAK to clarify the charges brought against the former official. Previously, the court had left it to the prosecution to correct the way the charges were formulated.
During the court hearing, Roshi's defense attorney, Andi Skënderi, argued that the prosecution's conclusions, the duration of the investigations, and the filing of charges are not in accordance with the procedural deadlines provided for by the legislation in force.
The court did not make public the reasoning on the tasks left to SPAK, while the full motivation of the decision is expected to be communicated to the parties after its disclosure.
According to the indictment, Elvis Roshi is suspected of having committed the criminal offense of abuse of office in connection with two procurement procedures conducted during 2014, one of which had as its object the cleaning service of the city of Kavaja. The investigations were also based on an audit by the Supreme State Audit Office (SSA), which found an economic damage estimated at around 33 million lek.
