An agreement requested by the Americans, signed in Tirana by Colin Powell and Fatos Nano and opposed from the beginning by the European Union, is being abrogated 23 years later by the Albanian government, without noise and without any public explanation for a decision that directly affects a delicate issue in relations between Albania, the US and the EU.
This concerns the 2003 Albania-US bilateral agreement on the International Criminal Court. With Law No. 97/2026, Albania has decided to terminate it, thus removing the guarantee it had given to Washington that American persons covered by the agreement, including military personnel, would not be surrendered to the International Criminal Court without the consent of the United States.
The story begins in 2003. Albania had just ratified the Rome Statute, while the George W. Bush administration had a serious problem with the new International Criminal Court. The US did not accept that its citizens and military personnel would risk ending up before an international court whose jurisdiction Washington had not accepted.
For this reason, the Americans began to search around the world for bilateral agreements based on Article 98 of the Rome Statute, in which states pledged not to extradite American persons to the ICC without the approval of the United States. The State Department itself explained at the time that the goal was to conclude such agreements with as many countries as possible.
US Secretary of State Colin Powell himself arrived in Tirana. On May 2, 2003, Powell and Prime Minister Fatos Nano signed the agreement. It entered into force on July 7 of that year.
Albania thus gave Washington what it wanted: if an American person covered by the agreement was in Albania, Tirana would not hand him over to the International Criminal Court without American consent. Official American documents list Albania among the countries that concluded precisely this type of agreement with the United States.
But the Albanian-American agreement became part of a larger clash between Washington and the European Union over the International Criminal Court. The Europeans defended the integrity of the Rome Statute and opposed agreements that created blanket exemptions for the Americans.
The European Commission wrote in 2004 that the agreement ratified by Albania "regrettably runs contrary" to the EU's guiding principles for Article 98 agreements. The US State Department also later acknowledged that Albania signed the agreement "in spite of strong EU objections".
Unless there is an error on the part of the administration of the Official Publications Center, the very content of the adopted law makes it necessary to clarify the date of publication, the date when the US was notified, and the moment when the agreement legally ceases to have effect.
In 2003, Colin Powell came to Tirana himself for the agreement that the Americans were seeking. Albania, at the time with its eyes on NATO, gave it to them. The European Union opposed it and for more than two decades urged Tirana to align itself with the European position.
Twenty-three years later, the Rama government has chosen the side long demanded by Brussels and is abrogating the agreement with the Americans. But this time, a decision affecting an agreement signed at the highest level with the US has been made without the noise, debate and public explanation that its weight would require.
