The Special Court of First Instance for Corruption and Organized Crime (GJKKO), with a panel composed of Judge Erjon Bani, has decided to reject the request of the Special Prosecution Office against Corruption and Organized Crime (SPAK) for the confiscation of the assets of Elvin Merlikë and eight persons associated with him.
In its decision, the court considered that SPAK's request was unfounded in law and evidence, also ordering the revocation of the seizure previously imposed within the framework of property proceedings No. 2 of 2022 and the return of the assets to their owners.
SPAK had requested the confiscation of 20 properties, including a hotel, apartments and luxury cars, on the grounds that they were unjustified from legal sources and could be considered the result of criminal activity.

100% of the shares of the company "Zeus Garden" sh.pk
49% of the shares of the company "MSG Security" sh.pk
100% of the shares of the company "London Eye" sh.pk
Real estate, including fields, apartments, land and forests in various areas of Tirana and Kurbi.
9 luxury vehicles of different brands.
The court has charged the Agency for the Administration of Sequestered and Confiscated Assets with the execution of the decision and has clarified that an appeal against this decision is allowed within 15 days at the Special Court of Appeal for Corruption and Organized Crime.
Today's decision follows SPAK's request in January of this year and confirms that the court has not found sufficient evidence to link the assets of Merlikë and persons associated with him to criminal activity.
