Former Attorney General, Adriatik Llalla, convicted of concealment and failure to declare assets, has requested the Special Court to suspend the execution of his prison sentence, claiming that the legal statute of limitations has passed.
The request was filed on October 12th through his legal representatives, who argue that five years have passed since the sentencing decision became final.
The former chief prosecutor was sentenced to two years in prison in 2021 for concealment and failure to declare assets. The decision was upheld by the Special Appeal on September 22 of that year, but was not executed after Llalla fled to Italy.
According to the Criminal Code, for prison sentences of up to five years, a five-year statute of limitations is foreseen for execution, under the conditions set forth by law. It is precisely on this provision that the former Attorney General's request is based.
In addition to the prison sentence, the court also ordered the confiscation of an apartment in Durrës and about 22,000 square meters of land on the outskirts of Tirana, as well as the removal of the right to exercise public functions for five years.
After leaving Albania, Llalla sought political asylum in Italy, where he was arrested in December 2021. He was later released for health reasons.
It is now up to the Special Court to assess whether the legal conditions for the statute of limitations for the execution of the sentence have been met. Accepting the request would not mean declaring Llalla innocent, but only not enforcing the prison sentence.
